Retreat Participation Waiver & Release of Liability

Please read this agreement carefully before participating in any retreat, workshop, event, wellness activity, or program offered by Manzano Mountain Retreat (“Retreat,” “we,” “our,” or “us”).
By signing this waiver, you acknowledge that you understand and voluntarily accept the risks associated with participation.
1. Assumption of Risk
I understand that participation in retreat activities may involve inherent risks, including but not limited to:
Physical exercise or movement activities
Hiking or outdoor recreation
Yoga, meditation, breathwork, or wellness practices
Exposure to nature, wildlife, weather, uneven terrain, or remote areas
Emotional or psychological experiences during personal growth activities
Group activities involving travel or shared accommodations
I voluntarily assume full responsibility for any risks, injuries, damages, or losses, known or unknown, which may occur as a result of my participation.
2. Health & Medical Responsibility
I certify that:
I am physically and mentally capable of participating in retreat activities.
I will consult a physician if I have concerns regarding participation.
I will disclose any relevant medical conditions, allergies, injuries, or dietary restrictions that could affect my safety or the safety of others.
I understand that Manzano Mountain Retreat is not a medical facility and does not provide medical treatment, diagnosis, or therapy.
I understand that I am solely responsible for my own health, wellbeing, medications, and personal care during the retreat.
3. Release of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Manzano Mountain Retreat, its owners, employees, volunteers, facilitators, instructors, contractors, affiliates, and representatives from any and all claims, liabilities, demands, damages, expenses, or causes of action arising from:
Personal injury
Illness
Emotional distress
Property damage or loss
Accidents
Delays or interruptions
Participation in any retreat-related activities
including claims arising from negligence, except in cases of gross negligence or intentional misconduct.
4. Emergency Medical Care
In the event of an emergency, I authorize Manzano Mountain Retreat to obtain medical treatment on my behalf if necessary.
I understand that I am responsible for any medical expenses incurred.
5. Personal Property
I acknowledge that I am responsible for safeguarding my own belongings. Manzano Mountain Retreat is not responsible for lost, stolen, or damaged personal property.
6. Photography & Media Release
I understand that photographs, videos, or recordings may be taken during retreat activities.
By signing this waiver, I grant Manzano Mountain Retreat permission to use my likeness in promotional materials, websites, social media, and marketing unless I provide written notice opting out before the retreat begins.

7. Code of Conduct
I agree to behave respectfully toward staff, facilitators, and other participants. Manzano Mountain Retreat reserves the right to remove any participant whose behavior is disruptive, unsafe, abusive, or inappropriate without refund.
8. Alcohol, Drugs & Prohibited Conduct
Illegal drugs, excessive alcohol use, harassment, violence, or dangerous behavior are prohibited and may result in immediate removal from the retreat.
9. Cancellation & Refund Policies
I acknowledge that I have reviewed and agree to the retreat’s cancellation and refund policies.
10. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of New Mexico.
11. Severability
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
12. Acknowledgment & Signature
I certify that:
I have read and understood this waiver.
I voluntarily agree to its terms.
I understand that by signing this document, I may be waiving certain legal rights.
13. Ropes Course, Pool, Posted Warnings & Prohibited Climbing
I understand that Manzano Mountain Retreat may have a ropes course, swimming pool, outdoor structures, farm equipment, decorative logs, natural features, buildings, fences, gates, and other property features on-site.
I acknowledge and agree that:
The ropes course, swimming pool, and outdoor recreational areas may involve serious risks, including falls, drowning, slips, trips, head injuries, equipment failure, rope burns, weather-related hazards, and other known or unknown dangers.
Use of the swimming pool is entirely at my own risk. I understand and acknowledge that Manzano Mountain Retreat does not provide a lifeguard or supervised pool monitoring.
I accept full responsibility for my own safety and the safety of any minor children in my care while using or being near the pool area.
I agree to follow all pool safety rules, posted signage, depth markers, and staff instructions at all times.
I may not enter, climb, use, or access the ropes course unless expressly authorized by Manzano Mountain Retreat staff and supervised by approved personnel.
I must obey all posted signs, warnings, barriers, instructions, and verbal directions from staff at all times.
Areas marked as restricted, closed, private, unsafe, staff-only, or “do not enter” are strictly off limits.
I may not climb on, sit on, stand on, hang from, move, or misuse any buildings, roofs, fences, gates, farm equipment, machinery, vehicles, decorative logs, landscaping features, furniture, railings, structures, or other property features.
I understand that decorative logs, farm equipment, and property features are not play equipment and may be unstable, hazardous, or unsafe for climbing.
I accept full responsibility for any injury, damage, loss, or claim resulting from my failure to follow posted warnings, staff instructions, or this waiver.
14. Farm Animals & Animal Safety
Manzano Mountain Retreat may have farm animals, livestock, petting areas, pens, cages, fenced enclosures, barns, and animal-related facilities on the property.
Guests acknowledge and agree that:
Interaction with animals involves inherent risks, including bites, kicks, scratches, pecking, trampling, allergic reactions, zoonotic illness, and unpredictable animal behavior.
Guests may only pet, feed, handle, or enter animal areas when expressly permitted by Manzano Mountain Retreat staff.
Children must be supervised by an adult at all times near animals, pens, cages, or fenced areas.
Guests may not climb on, lean over, enter, open, damage, or reach into animal pens, cages, gates, fences, stalls, or enclosures unless authorized by staff.
Guests must follow all posted animal safety signs, warnings, and staff instructions.
Manzano Mountain Retreat is not responsible for injuries, illnesses, allergic reactions, or damages resulting from contact with animals or unauthorized entry into animal areas.
Guests voluntarily assume all risks associated with animal interaction and release Manzano Mountain Retreat, its owners, employees, contractors, volunteers, and representatives from any liability arising from contact with animals, animal enclosures, pens, cages, or related facilities.
